Amendment to SWMBH Intergovernmental Contract
Submitted For: Kelli Scott
FROM: Kelli Scott, Administrator/Controller, Administration
Department: Administration

Information
RESOLUTION:
Be it Resolved, that the Calhoun County Board of Commissioners hereby approves the First Amendment to the Intergovernmental Contract between Southwest Michigan Behavioral Health Regional Entity ("SWMBH"), Barry County, Berrien County, Branch County, Cass County, Calhoun County, Kalamazoo County, St. Joseph County and Van Buren County, as presented.
RECOMMENDATION:
County Administration recommends approval of the attached First Amendment to the SWMBH Intergovernmental Contract as presented.
BACKGROUND:

SWMBH was created following passage of new State legislation requiring regional entities designated by the Michigan Department of Health and Human Services (MDHHS) to coordinate the provision of substance use disorder services.

An Intergovernmental Contract sets forth the terms and conditions for the establishment of a Substance Use Disorder (SUD) Oversight Policy Board, which is also a requirement of the State legislation passed in 2012.  The SUD Oversight Policy Board approves PA2 budgets for all 8 counties that are parties to this contract, among other functions.  Each County's Board of Commissioners appoints up to two members, either Commissioners or other residents, to the SUD Oversight Policy Board.  Commissioners Kathy-Sue Vette and Rochelle Hatcher currently represent Calhoun County on this Board.

The County Board of Commissioners approved renewal of the Intergovernmental Contract on August 6, 2020.

This First Amendment is being submitted by SWMBH on behalf of Kalamazoo County, which has already approved the Amendment.  The purpose is to add nondiscrimination language that Kalamazoo County requires in each of its contracts.

ALTERNATIVES:
This Contract is required under State law in order for SWMBH through its Substance Use Disorder Oversight Policy Board to approve our annual PA2 budgets and coordinate contracts with our providers .
SUMMARY:
Based on review by the County's Corporation Counsel, County Administration recommends approval of the attached First Amendment to the SWMBH Intergovernmental Contract as presented.

Fiscal Impact
BUDGETARY IMPACT:
There is no direct budgetary impact from this PA2 Intergovernmental Contract.
